Validity of the offer

The offers presented are valid only while stocks last. Each product page gives information on its availability.

A product is available when the mention "buy online" is shown. Products without this mention are items already sold and published in the sales history - a search request is nevertheless possible by e-mailing info@artetor-bordeaux.fr.

07

Prices and delivery

Prices are shown in euros, all taxes included. Delivery costs, time and method are indicated before the order is confirmed; delivery is free for purchases of €250 or more. The summary displayed before payment states the total price to be paid.

The order is confirmed by e-mail. Jewellery is insured in transit until handed over; if delivery does not take place within the announced time, you may give us formal notice and then, failing performance, cancel the sale and be refunded (articles L216-1 et seq. of the French Consumer Code).

08

Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, you have 14 days from receipt of your order to exercise your right of withdrawal, without having to give reasons or bear any costs other than those set out below.

To exercise it, inform us of your decision by an unambiguous statement, by e-mail to info@artetor-bordeaux.fr or by post to BGC, 55 rue Saint-James, 33000 Bordeaux, France, using if you wish the withdrawal form below. Then return the product, preferably in its original box and with its invoice, no later than 14 days after informing us. Return costs are at your expense; for a valuable piece, we recommend an insured shipment.

We will refund all sums paid, including the initial delivery costs (on the basis of the standard delivery method), no later than 14 days after being informed of your decision, using the same means of payment as for the order, unless otherwise agreed. We may defer the refund until the product is received or until proof of its dispatch is provided.

You are liable only for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

Exception: in accordance with article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to jewellery made to your specifications or clearly personalised, in particular pieces that have been altered at your request (resizing, engraving).

09

Payment methods

You may pay by:

- Online: bank card (secure 3-D Secure payment via CAWL), PayPal, and interest-free instalments with Alma, subject to acceptance of your application by Alma
- On request from our shops: bank transfer, personal cheque (France only)

Your card details are entered directly with the payment provider: Art & Or never has access to them. The order is recorded once the payment has been authorised.

10

Legal guarantees

All our jewellery, new or pre-owned, is covered by the legal guarantee of conformity and the guarantee against hidden defects, under the conditions set out below (article D211-2 of the French Consumer Code).

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared. For second-hand goods, the period during which the defect is presumed to have existed at the time of delivery is twelve months.

The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement takes place after a period of thirty days; 3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination. In that case the consumer is not required to request repair or replacement beforehand. The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee until the repaired goods are delivered. The above rights result from the application of articles L217-1 to L217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To invoke a guarantee, contact us at info@artetor-bordeaux.fr or on +33 (0)5 56 44 47 69.

Complaints and mediation

For any complaint, first contact our customer service: info@artetor-bordeaux.fr, +33 (0)5 56 44 47 69, or BGC, 55 rue Saint-James, 33000 Bordeaux, France. We undertake to reply as soon as possible.

These terms are governed by French law. Failing an amicable agreement, the dispute will be brought before the competent court under the ordinary rules; the consumer may choose the court of the place where they lived when the contract was concluded or when the harmful event occurred.
